We know that many have the right to Italian citizenship and don’t even know it. Or, when they are aware of their right, they don’t know where to start the process or what documentation should be collected. So let’s check the documents that are required, and how they must be submitted for your application to be approved. Come on?

1) Circular K28

As a reference for the recognition of Italian citizenship, we use circular K28 (Circular No. K. 28.1 of April 8, 1991 issued by the Ministry of Foreign Affairs) which regulates the process of recognition of citizenship for foreigners of Italian origin. It guides what documents are needed to start the process. The main documents are the birth and marriage certificates of the applicant and his ascendants until reaching the Italian ascendant. Let’s take a small example by direct ancestry:

The application for citizenship by descent from an Italian great-grandfather: What are the documents to be presented by the applicant? How to know where the great-grandfather lived to have access to his documentation?

First, we start to analyze the documentation of the applicant for Italian citizenship. We go from the applicant through his direct ascendants until the Italian great-grandfather. Thus: APPLICANT’S GREAT-GRANDFATHER – APPLICANT’S GRANDFATHER – APPLICANT’S FATHER ⇐ APPLICANT

Necessary Documents

You will need birth and marriage certificates, for everyone on this scale and all descendants who wish to recognize their Italian citizenship jus sanguinis. On the GRANDFATHER’S birth and marriage certificates, you will have important information to locate the applicant GREAT-GRANDFATHER’S certificates, such as where he was born in Italy. After that, it is possible to contact the Comune or the local Parish in Italy.

In Italy, civil registration began to be implemented in Veneto from 1860 onwards. However, it was not until 1871 that the Italian civil registration became mandatory. When the Italian ascendant does not have a civil birth certificate

When the Italian ascendant does not have a civil birth certificate, the baptism certificate is valid as a document for the recognition of Italian citizenship.

All documentation must be FULL CONTENT. In other words, in cases involving financial matters or that are of a diplomatic nature, full content documentation is mandatory. In specific processes for the recognition of Italian citizenship, consulates require this type of documentation, regardless of whether the process is carried out in Italy or in the applicant’s country.

Why this requirement?

Full Content documentation is more complete in information. The regular certificates are more concise in terms of the data provided. In full content certificates, further data can be included, such as annotations, paternity, among others. Being more complete, it provides a better analysis by official agents.

2) Negative Naturalization Certificate

Another important document for the process of recognition of Italian citizenship is the CNN, Negative Naturalization Certificate. It is done on the Ministry of Justice website and can be done for free on the internet, as well as its authentication.

The application for the Negative Naturalization Certificate must be made in the name of the applicant, with one CNN per applicant. Each request for citizenship recognition must have the CNN of the Italian ascendant.

The Negative Naturalization Certificate serves to inform that there is no registration of naturalization in the name of the researched person. The Italian ascendant cannot have undergone a naturalization process in another country. This certificate serves to prove this.

Documentation analysis

With the documents in hand, it is important to analyze them in detail. Place and date of birth, surnames, first names, names of spouses, among others. The information in a document must be identical to the others. This analysis is very important in the process of recognizing Italian citizenship. If there is any discrepancy, it needs to be rectified. Some issues depend on the interpretive analysis of the COMUNE officer.

How to know if you need documentation correction?

When an applicant goes to Italy to undergo the citizenship recognition process via Comune, we advise to rectify all documentation. This way, there will not be any unexpected event when the Comune officer is going to analyze the documents.

Within this theme, we mention the issue of death certificates. According to K28, the use of these certificates is not necessary. However, this will also depend on the Officer’s interpretation. It has an administrator, or Manager, and the Communal Council, the equivalent of mayor and city council. In total, Italy has today: 20 regions, 109 provinces, and 8,103 comunes. It is therefore in the Comune that the applications for Italian citizenship are analyzed by an officer.
